1.New proposal for a public on-demand service with focus on fiction (movies and series)

The presented proposal for a public on-demand service focusing on fiction (movies and series) is both supposed to properly account for the significant transition in the use of media as well as guarantee the availability and accessibility of ORF productions through the provision of an own public on-demand service. As a result not only consumers but also the Austrian production companies will profit.
On October 25, 2017 ORF already delivered a proposal for a public on-demand service with focus on fiction (movies and series) to the KommAustria, the Austria Federal Chamber of Labor (Bundesarbeiterkammer) and the Austria Federal Economic Chamber (Wirtschaftskammer Österreich). With the (not yet legally valid) administrative decision from May 9, 2018, KommAustria refused the application of the ORF due to uncertainties in the financing plan.

The ORF would like to present detailed information about the financing plan within the new proposal now.
With the proposal at hand for a public on-demand service focusing on fiction (movies and series) the ORF fulfills its obligation to conduct a prior evaluation. With the publication, the ORF submitted the proposal to a preliminary investigation in order to start the prior evaluation and is inviting all persons affected by the new offer to express their opinion until March 27, 2019.

2. Proposal for a public on-demand service with focus on fiction (movies and series)

With the proposal at hand for a public on-demand service focusing on fiction (movies and series) the ORF fulfills its obligation to conduct a prior evaluation. With the publication, the ORF submitted the proposal to a preliminary investigation in order to start the prior evaluation. All persons affected by the intended service were invited to submit their opinions until September 11, 2017. With the involvement of the Public Value Advisory Council (§ 6c ORF Act) and the Federal Competition Authority, KommAustria did not approve the new online service by an administrative decision per May 9, 2018 (KOA 11.280/18-004). The administrative decision has been challenged at the Federal Administrative Court.

3. Proposal for the development of the ORF offer in Social Media

The proposal focuses on the development of the ORF offer in Social Media.
This new development should strengthen the additional value
of the ORF offer in social media. Furthermore the ORF offer shall be partially
complemented and overall created more accessible in Social Media.

ORF has handed in the proposal for the ordering verification.

As a result of the incoming statements it is the ORF's opinion that changes to the proposal were to be made respectively an amendment of the proposed concept iSd § 6a Abs 3 ORF-G, that you can find here (in the proposal through cancelations during the altering mode). If you wish to comment on the amendments please feel free to write an email to (stellungnahmen@orf.at).
In order to obtain the approval of the proposal the ORF has already filed an application at KommAustria.


3. Proposal regarding oe3.orf.at amendments: Ö3 - Live/visual

Ö3 offers a twenty-four-seven simulcast stream on oe3.orf.at ("Ö3-Live"). The sub website "Ö3 -Live" features a podcast player, which provides the audience with additional information directly connected to the ongoing programme (for instance the title of the current podcast, news or song titles). In order to preserve and enhance the popularity and to remain up-to-date, "Ö3 -Live" has to improve their services in terms of moving image. These are live images of the studio (the current service on oe3.ORF.at already contains a webcam) and music videos, which will be shown during the songs.

The improvements of "Ö3-Live" is an online service of the Austrian Broadcasting Corporation according to §4f Abs 1 ORF Act, which makes an effective contribution to the fulfilment of the public-service mandate (§4 ORF Act).

With the proposal at hand for "Ö3-Live/Visual" as a change to the concept of oe3.ORF.at (May 26, 2011), the Austrian Broadcasting Corporation fulfills its obligation to conduct a prior evaluation. With the publication, the ORF submitted the proposal for a change of oe3.ORF.at "Ö3-Live/Visual" to a preliminary investigation in order to start the prior evaluation. All persons affected by the intended service were invited to submit their opinions until July 3, 2014. With the involvement of the Public Value Advisory Council (§ 6c ORF Act) and the Federal Competition Authority, KommAustria did not approve the new online service by an administrative decision per February 18, 2015 (KOA 11.266/15-001). The administrative decision has been challenged at the Supreme Courts.
