Proposal for radiothek.orf.at


This proposal focuses on the development of Radiothek. The proposal suggests amendments to the public value of the audio service of the Austrian Broadcasting Corporation regarding the content and technology area in terms of broader variety, easier access and better findability as well as better usability for the users. As a central catch-up & demand audio platform, Radiothek provides a considerable added value in comparison to the general radio.ORF.at website, it will replace and expand it.

Radiothek is an online service of the Austrian Broadcasting Corporation according to the ORF Act §4f Abs 1, which makes an effective contribution to the fulfilment of the public-service mandate (§4 ORF Act) and for which a prior evaluation had to be carried out. With the publication, the ORF submitted the proposal to a preliminary investigation in order to start the prior evaluation. All persons affected by the intended service were invited to submit their opinions until July 3, 2014.

On July 29, 2014, the proposal was submitted to the regulatory authority (KommAustria) with the application for a permit. With the involvement of the Public Value Advisory Council (§ 6c ORF Act) and the Federal Competition Authority, KommAustria approved the new online service by an administrative decision per July 22, 2015 (KOA 11.277/15-004). After a complaint of the Federal Competition Authority had been rejected by the Federal Administrative Court, the approval decision is legally valid with November 23, 2018.

2. Focus service archive

Proposal oesterreich.ORF.at amendment



A archive featuring Radio Voralberg programs "Focus- topics for life" should be provided at vorarlberg.orf.at and therefore the current service of oesterreich.ORF.at should be amended. In the programs well-respected speakers provide and elaborate their understanding of live and support the audience to get a better understanding of the world.
For this new concept a order verification examination has been executed (§ 6 ORF Act). ORF established a proposal regarding the changes of oesterreich.ORF.at. In order to allow all affected environments to give statements, ORF published the proposal on 26.6.2012. KommAustria, the Public Value council and the federal competition board (BWB) approved the proposal 14.11.2012 (§6 ORF Act).

3. Ö1 goes school



The amendments of the federal law give ORF more opportunities regarding online-activities (§§ 4f iVm 50 Abs 3 Z 2 ORF Act). In order to give affected environments the opportunities to submit statements, ORF published on 31.3.2011 ORF published an elaborated concept proposal about a teaching and study service "Ö1 goes school". On 23.5.2011 the proposal was presented to KommAustria, which approved the proposal in corporation with the federal competition board and Public Value council on 21.11.2011.

Until the 16.11.2012, all affected people had the chance to submit statements regarding the planned services.


4. ORFIII - culture and information



As a result of the amendment of the federal laws in October 2010, ORF launched the information-oriented thematic channel ORF III. Prior to the launch, the elaborated proposal had to pass the order verification examination.
ORF published the ORF III online and offline activities proposal on 5.11.2010; furthermore, ORF submitted the proposal on the 23.12.2010 to KommAustria. On 18.5.2011 ORF PV council, the federal competition board and KommAustria approved the proposal.

5. TVthek.ORF.at


The aim of this proposal was to grant affected people and publics the possibility to comment on TVthek.orf.at. On 26.11.2012 the proposal was submitted to KommAustria and in July 2013 the proposal was partially approved by the Public Value council and KommAustria.

6. Proposal for changes of the ORF service on social media

This proposal for changes of the ORF service on social media aimed at strengthening the public value of the ORF service on social media, partially complementing the offer and making it more easily accessible.


For such a change, a prior evaluation (§6 ORF Act) had to be conducted. The ORF formulated a proposal and published it in order to allow for all persons affected to submit their opinion (see below). On April 18, 2017, the proposal was submitted to the regulatory authority (KommAustria) with the application for a permit. With involvement of the Public Value Advisory Council (§6c ORF Act) and the Federal Competition Authority (BWB) and by administrative decision on May 9, 2018, the KommAustria did not approve the provision of the online service. The administrative decision is final.
